Privacy Notice EHR

1. Introduction

This Privacy Notice identifies how Cerbo uses, shares, and protects the personal information it collects from Users.  Personal information collected is used for internal business purposes and to make Services available to Users.  Cerbo neither sells personal information nor intends to sell personal information collected through  Services (in a business-to-business context).

2. Personal Information, Sources of Personal Information and Business Purpose

  1. Personal Information.  Cerbo collects information that identifies, relates to, describes is reasonably capable of being associated with or could reasonably be linked (directly or indirectly) with a particular consumer or household “personal information”.  
  2. Sources of Personal Information. Sources of information are as follows:
    1. When You Access and Use Services.  Cerbo receives personal information when Users create an Account, contact Cerbo for assistance, share User Content, and take similar actions within Services.
    2. Network Data.  The IP address associated with the network used to access Services is collected when Services are in use.  Cerbo may use this information to authenticate a User and/or to prevent fraudulent activity.
  3. Business Purpose.  Cerbo has a legitimate business need for collecting the personal information identified herein for the purposes of making Services available to Users and as otherwise set forth in this Privacy Notice.

4. How Cerbo Uses Personal Information

The personal information collected is used as follows:

  1. To make the Services available to Client and their Users, monitor performance of Services, respond to inquiries, and provide customer support.
  2. To create, develop, operate, deliver, and improve Cerbo Content, User Content, and Services.
  3. To protect Services and Users, as well as to enforce Cerbo’s rights under this EULA (specifically for anti-fraud purposes, and to prevent illegal or unauthorized activity).
  4. To verify that Users are properly licensed and/or that Users are authorized to use Services.
  5. For internal purposes such as auditing, data analysis, and research.
  6. To generate aggregated data which is created after removing personal information that identifies an individual.
  7. Addressing our compliance and legal obligations.

5. How Cerbo Shares Your Personal Information

  1. Service Providers.  Personal information may be shared with vendors to assist with:  (i) making Services available; (ii) conducting quality assurance testing; (iii) providing technical support; and/or (iv) maintaining Services (“Service Providers”).  Service Providers are only permitted to use personal information in a manner consistent with this Privacy Notice.  
  2. Legal Compliance.  Cerbo cooperates with government and law enforcement officials, and private parties, to enforce and comply with applicable law.  Therefore, Cerbo reserves the right to disclose personal information to government or law enforcement officials, or private parties, in response to lawful requests when such disclosure is necessary to comply with any legal obligation, enforce the EULA, respond to claims, and legal process.

6. Your Rights

Subject to verification of identity and other information, all California consumers have the following rights:

  1. Right to Know.  The right to know what categories of personal information are being collected, with whom such is being shared with and for what business purpose.
  2. Right of Erasure.  The right to request deletion of the personal information provided.
  3. Right to Opt-Out.  The right to opt-out of targeted advertising and/or the sale of the personal information provided.  Please note that Cerbo does use targeted advertising and does not sell any personal information.
  4. Right to Know to Whom We Disclose Your Personal Information.  Cerbo uses Services Providers solely for the purpose of making Services available to Users.  
  5. Right Against Consumer Discrimination.  The right to not be discriminated against as a consumer by:  (i) denial of Services; (ii) paying more for Services; and/or (iii) receiving lesser quality of Services.
  1. Right to Access.  The right to request access to or copies of the personal information provided.
  2. Right to Limit.  Subject to certain exceptions, You have the right to request that Cerbo limit the use of Your sensitive personal information.
  3. Right to Correct.  You have the right to correct any inaccurate personal information collected by Cerbo.  Generally, Users can update any inaccurate information through their Account.

Users must submit inquires and data subject requests to Cerbo through their employer who has entered into the Master Subscription Agreement with Cerbo.

7. Cookies

Cerbo may use Cookies or other tracking technologies as pixel tags and web beacons.  These are used in order to store content information and preferences, analyze trends, administer and maintain Services, and to monitor User interaction with Services.  Users can control the use of Cookies at the individual browser level.  If Cookies are rejected, a User’s ability to use and/or access certain features of Services will be fundamentally diminished.

  1. Information Security and Confidentiality

No method of transmission over the Internet or method of electronic storage is 100% secure.  Therefore, Cerbo cannot guarantee the absolute security of Services.  Cerbo and its Service Providers use generally accepted standards of organizational, administrative, physical, procedural, and technological measures designed to protect personal information from improper loss or misuse, and unauthorized access, disclosure, alteration, and destruction during processing.
